Trustees Acting Badly

A Halloween party at a NY foreclosure mill resulted in an uproar and and a condemnation in a Times editorial. However, Times never misses an opportunity to miss an opportunity to discuss the underlying problem.

In this case, it is not the costumes or the apparent disregard for the plight of debtors in foreclosure that is the issue of concern. Instead, the issue is that those entities that routinely handle foreclosures are overwhelmed and burnt out - the trustees, the banks,the debtors' attorneys and the judges.

Yes, the third-party squatters, the claims of missed affidavits, service challenges are a daily occurrence. The majority of the trustees, in our experience, remain pleasant and accommodating through it all. They will entertain reasonable offers and respond to legitimate claims. However, even if some trustees are cavalier and uncouth, it does not really matter.

It does, however, matter if the judges have become desensitized to the constant pleas of missed affidavits, alleged service failures, etc.
